These Terms of Service ("Terms") govern your access to and use of the website located at swiftnetscan.com and the SwiftNetScan Pro subscription (together, the "Service"). The Service is operated and provided by SwiftNetScan (the "Seller," "we," "us," or "our"). By accessing or using the Service, you enter into a binding agreement with SwiftNetScan and agree to be bound by these Terms. If you do not agree, you must not use the Service.
1. Service Description
SwiftNetScan provides browser-based internet speed testing tools that measure your connection's download speed, upload speed, latency (ping), and jitter, together with educational content about internet connectivity and networking. Core speed testing tools are offered free of charge. SwiftNetScan also offers a paid subscription, SwiftNetScan Pro, which unlocks advanced learning content and features.
1a. Payments, Subscriptions and Merchant of Record
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all SwiftNetScan Pro orders. Paddle provides all customer service inquiries related to orders and handles returns and refunds. When you subscribe:
- Fees and billing frequency — the price and billing frequency (monthly or annual) for SwiftNetScan Pro are shown on our pricing page at the time of purchase. Prices are quoted in the currency shown at checkout and may include applicable taxes handled by Paddle.
- Automatic renewal — subscriptions renew automatically at the end of each billing period at the then-current price for that plan, until cancelled.
- Cancellation — you can cancel at any time from your account or via paddle.net. On cancellation, access continues until the end of the paid period and the subscription will not renew.
- Refunds — refunds are governed by our Refund Policy, which includes a 30-day money-back guarantee on new SwiftNetScan Pro purchases.
- Taxes — Paddle calculates, collects and remits applicable sales tax, VAT, GST and similar taxes as required by law.
- Payment terms — payment for subscriptions is due at the time of purchase and at each renewal. Additional payment mechanics (including retries on failed payments, currency conversion, and invoicing) are governed by Paddle's Buyer Terms, which you also accept at checkout.
2. Acceptable Use
You agree to use SwiftNetScan only for lawful purposes and in accordance with these Terms. Specifically, you agree not to:
- Use automated scripts, bots, scrapers, or other automated tools to run excessive or repeated speed tests that may overload our infrastructure
- Attempt to interfere with, disrupt, or compromise the Service, its servers, or connected networks
- Use the Service for any illegal or unauthorized purpose
- Use SwiftNetScan's tools to test, scan, or probe networks, systems, or devices that you do not own or are not explicitly authorized to test
- Reproduce, duplicate, copy, sell, or exploit any part of the Service without our prior written permission
- Attempt to reverse engineer, decompile, or extract the source code of any proprietary speed testing technology used by the Service
- Misrepresent speed test results, fabricate data, or use our results in misleading advertising or fraudulent claims
- Impersonate any person or entity, or falsely state or misrepresent your affiliation with a person or entity
3. Network and System Authorization
By using SwiftNetScan, you represent and warrant that you have proper authorization to test the network connection you are measuring. You should only run speed tests on internet connections that you own, pay for, or have explicit permission to test. SwiftNetScan is not responsible for any unauthorized use of our tools on networks or systems you do not have permission to access.
4. Accuracy Disclaimer
Speed test results are approximate measurements of your internet connection performance at a specific point in time. Results can vary significantly based on numerous factors, including but not limited to:
- Network congestion and traffic patterns
- Server load and geographic distance to test servers
- Your device's hardware capabilities and current resource usage
- WiFi signal strength, interference, and router quality
- Your internet service provider's network conditions
- Browser version and active extensions
Speed test results should not be used as the sole or primary basis for legal claims against your internet service provider. They are intended for informational and diagnostic purposes only.
5. Intellectual Property
All content on SwiftNetScan — including but not limited to text, graphics, logos, icons, images, audio clips, data compilations, software, and the overall design and arrangement of the website — is the property of SwiftNetScan or its content suppliers and is protected by international copyright, trademark, patent, and other intellectual property laws.
You are granted a limited, non-exclusive, non-transferable license to access and use the Service for personal, non-commercial purposes. This license does not include the right to modify, distribute, reproduce, or create derivative works from any part of the Service.
6. User-Generated Content
If you submit any feedback, suggestions, or other communications to us, you grant SwiftNetScan a non-exclusive, royalty-free, perpetual, and irrevocable right to use, reproduce, modify, and distribute such content for any purpose, without compensation or attribution to you.
7. Third-Party Content and Advertising
The Service may display advertisements from third-party ad networks, including Google AdSense. We are not responsible for the content, accuracy, or opinions expressed in third-party advertisements. Your interactions with advertisers, including any purchases or agreements, are solely between you and the advertiser. We are not liable for any loss or damage arising from such interactions.
Our website may also contain links to third-party websites or services. We do not control and are not responsible for the content, privacy policies, or practices of any third-party sites.
8. Limitation of Liability
To the maximum extent permitted by applicable law, SwiftNetScan and its operators, affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, arising from:
- Your access to, use of, or inability to use the Service
- Any conduct or content of any third party on the Service
- Any content obtained from the Service
- Unauthorized access, use, or alteration of your data or transmissions
The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
9. Service Availability
We strive to keep SwiftNetScan available at all times, but we do not guarantee uninterrupted or error-free access to the Service. The Service may be temporarily unavailable due to scheduled maintenance, server issues, network problems, or circumstances beyond our control. We reserve the right to modify, suspend, or discontinue the Service (or any part of it) at any time without prior notice.
10. Indemnification
You agree to indemnify, defend, and hold harmless SwiftNetScan, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.
11. Termination and Misuse
We reserve the right to restrict, suspend, or terminate your access to the Service at any time, without prior notice or liability, for any reason, including but not limited to a breach of these Terms. Upon termination, your right to use the Service will immediately cease.
If we detect automated abuse, excessive load generation, or any activity that threatens the stability or security of our infrastructure, we may block your access without warning.
12. Modifications to Terms
We reserve the right to update or modify these Terms at any time. When we make changes, we will update the "Last updated" date at the top of this page. Your continued use of the Service after any changes constitutes acceptance of the revised Terms. We encourage you to review these Terms periodically.
13. Severability
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
14. Governing Law
These Terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the appropriate courts of the applicable jurisdiction.
